  Filing I-30 and it's consequence?

If  ROSE is married with a green card holder and filed I-30 just to be in queue in 2006? The I-30 is still in pending,  not heard  from Immigration but the gentleman got his citizenship and files green card to his spouse.
Because of  pre-filed I-30 and being in pending , his spouse green card is rejected at this point.

Was the filing I-30 backfire him ? Or we learn a lesson that we should not be filing I-30 to spouse if we are getting citizenship soon in near future?

You should withdraw the I-30 b4 filing for GC. Ask a lawyer...right suggestion worth some money..

I agree , ask a lawyer , rather than someone giving useless suggestion in Sajha .If this is for the spouse , them money spent on lawyer is well worth it ....

So, the 1-30 filed in 2006 can be withdrawn? Can we do ourselves  or hire a lawyer?

My case is little different.


My father is US citizen and filed I-130 for me in 2003 when I was in H1B status. Later I got my green card from my employment in 2007. Recently I looked at the I-130 status and it said that my I-130 through my father was denied. I just ignored it.

An applicant or petitioner may withdraw an application or petition at
any time until a decision is issued by the Service or, in the case of
an approved petition, until the person is admitted or granted
adjustment or change of status, based on the petition. However, a
withdrawal may not be retracted. An applicant who wishes to withdraw a
visa petition (Form I-130, Petition for Alien Relative) should write a
letter to the BCIS office where the petition was filed. The letter
should include the beneficiary's name, date and country of birth, and
A-number or Receipt -number, the date petition was filed, reason for
withdrawing the petition and the petitioner's name, signature and
address. "

Hi Syanjali ji,

What was the resign for rejection I-130. Did they mention any reason for rejection. Can he not refile again with the sufficient documents.

Applied for green card along with new I-30, got a letter of not approval because of past filed I-30 has not be decided yet.( This much I know).
