It might be painful for those whose TPS is still pending and those might be worrying what if TPS does not extend after DEC 2016 dead line.
What do you think about TPS extension ? If it extend, it will be a great relief for those who are trying to change status to some other status and with EAD, they can legally able to work.
Since its already March, just 9 months left before it gets expired, is there any PLAN B if TPS does not extend ? What are the alternatives? Lets share and request our immigration lawyers who visit this forum to share their valuable suggestions too.
Lets not make any nasty and irrelevant discussions for the benefits of sharing right information.

I think they were only announcing extension just before 2 months time .FYI TPS for Honduras etc. is going to expire on July 5 2016 and dhs have not announced yet. I think they will do in May 5th which would be 2 months prior to their expiration. So, only on October 24 we will gonna know about the extension on NEPAL TPS extension

Once you receive H1B, you have to go to Nepal/Canada or any other country where you can stamp H1B visa and re-enter US under H1B status. If you do not want to leave US, thats fine too. But once you leave country, you have to get visa based on H1B from US embassy in Nepal or Canada or elsewhere where such service is provided. Do some research where you can go but it might takes more than 3 weeks for security clearance and if you work with consultancy, it might even take longer. So plan ahead before you leave.

History is on our side bros. Looking at other countries' situation and also the fact that there has been zero development or recovery from the earthquake in Nepal (thanks to our incompetent politicians), it is very much likely to be renewed. Plus, TPS provides the US govt. with revenue (fees from registration and re-registration) and since Nepalese in the US aren't that big of a population like from our neighboring countries, it doesn't hurt the US govt. to renew TPS. At least ek choti chahin hunchha if not more, me thinks. We will find out in Sep-Oct.

lots of people here have guess work, nice imagination and prayer service. Yes THE TPS EXTENSION seems automatic looking at other cases but it is the way it is because those countries govt. lobbied for it for extension. So if you are in TPS and like to stay for while ask your embassy here to write/ lobby for it before expiration otherwise it may not have extension folks.. I know lots of nepali fellow have benefited from TPS and I'm very happy for them hence my two words of advice.

p.s I was just wondering how many Indians took advantage(they just have to prove their last resident was in nepal so and so and we all know indians are no 1 producing fake documents) of this TPS for nepal any idea ? is that why TPS approval taking so long since no. are high ? i often see in threads complain here so just wondering. ..

Do you know how much should we pay for travel documents? If urgent, where should we go and how can we apply Travel document? Somebody is saying we can get it within minutes from field office if urgent. What does it means? Where is field office to apply urgent Travel document? If urgent we have to show some extra documents. What is extra documents? Do we need to bring extra documents, such as medical report from Nepal? if you have ideas please give me detail information.
Thanks

rc , yes you can make the travel document right there in the field office. Yes they will need evidence of the surgery such as medical reports from nepal. Cost is about $360 i think.

Bakbaas_kura,

Since you have already received EAD through TPS, that means your current status is EAD pending and F2 on hold. Please confirm with USCIS before leaving US otherwise you will have problem at POE, if you travel without AP. Like so many other people have said in the forum, you can apply for AP at the USCIS service center if you are in emergency. You can show them the reason why you have to go to Nepal under emergency. If you apply AP , it will take 3 months normally.

So, since these TPS is a gray area, I always do recommend to consult professional lawyer, in this case, any Nepali Lawyer might be helpful to you know knows better about TPS than other immigration lawyer. Do not take risk at any cost.

well...a little too late. i'm already in Nepal. so yes, i abandoned the TPS application but my F2 should still be valid, no? I'll be returning to US in few months...hopefully I won't have issues at POE

Oh Yes, if you have valid F2 stamped while entering US and F1 status too (as you are dependend on F1), they might ask about your spouse F1 and his/her academic credit and GPA (keep a copy of those with you, if they ask at all at POE). I believe there should not be any problem but return to US 6 months before F2 status expires. If your F2 visa is valid for 1 month and trying to enter US, you might have problem. Not sure though. So always minimize risk when it comes to immigration matters. Enjoy your stay there.

Yes...my spouse has been maintaining F1 status and will be in Nepal for Dashain and will also renew F1 visa because that expired almost 2 years ago. My F-2 visa stamp is valid for next 3.5 years or so and since we'll be returning to US together, I'm hoping there won't be issues at the POE. Thanks for the heads up neerman

Hey, your statement '...will also renew F1 visa because that expired almost 2 years ago' raised my eyebrow. What do you mean by F1 Visa expired 2 years ago ? Did he maintain F1 status with SEVIS and received new I-20 from University ? Make sure you have all those documents handy while applying for F1 visa renewal. I am sure your case is not complicated if F1 status is maintained intact.

expired meaning the F-1 visa stamp/sticker on the passport expired in 2014, but F-1 status has been maintained, never been out of status, just need a new visa sticker to enter back to US
