Hello Kaamchaiyoo, If you just want to get work authorization visas like H1b immediately to begin working, there are many hospitals in CA and TX that I know of. They might surely be in other states as well. In Dallas, TX there is Parkland hospital, in Fort Worth there's JPS and there are a bunch of others, if you search, that will sponsor you an H1B for now and will eventually sponsor Green Card. These hospitals will process your GC after you've worked for them for a year or so, if I am not wrong, because that's what I have known the case to be for some of my RN friends. So, Good Luck!

Nurses don't have H1B visa category. They only have H1C which is very rare. Nurses don't need a labor certificate to aplly for a GC under EB3 category. So i suggest you talk to a lawyer. You only have half a month to apply. Good Luck.

Nurses certainly do not qualify for H1B and do not need labor cert. for GC. EB3 is backlogged for sure. Also, as far as I know u can only file for I140 by the end of July which mean u have only 4 days left and is not possible. The only other option for nurses is H1C. I know of two hospitals that qualifies for it: McAllen Medical Center and Mercy Medical center in Baltimore, MD. Mercy does not accept new grads for this so u better get hold of McAllen.

Few things about Nursing in US. 1. A registered nurse needs to have either ADN or BSN degree and should have passed NCLEX exam. 2. 500 visas are availabe if they wish to work in underserverd area, known as H1C, and its already gone for this year. 3. Their catagoy is known as Schedule A, and is placed in EB3 catagory. 4. They don't require labor certification, but has to file labor within department of labor. 5. Once the dept of labor clears their petition, they can apply I-140 and I-485. 6. I-140 can be applied anytime once the DOL clears the petition, but in order to file for I-485 the cutoff date should be current or should be under the priority date. The date you file your I-140 establishes your priority date for Nurses. 7. For nurses if they are going to adjust their status, they need to have Visa Screen Certificate as well. But I-485 can be filed without it, later you have to provide VSC once you get RFE from USCIS. 8. Not all hospitals sponsor the petitions, but many hospitals in Arizona does sponsor them, given the fact that they have passed their NCLEX exam. 9. The current visa bulletin fiasco has extended the timeline to file the petition till August 17th. But since its almost impossible for nurses to file their I-140 within few days (as the labor needs to be granted from DOL), they are more likey unable to file I-485. In order to file I-485 until August 17th, your priority date should be before July 31st. 10. Nurses can file their I-140 anytime. Due to heavy hike in fees starting July 30th, now they have to pay $485 for I-140 instead of $195. 11. Most of the hospital covers for their attorney fee and the USCIS fee, but it seems like there won't be any visa available. 12. Advise: Find a job in a hospital or whosever is willing to sponsor you, if you are in OPT. Once your I-140 is filed, you should only need to wait for the cutoff date. Due to high demand of nurses, they might ease out some solution which gives you immediate entry than others. 13. Any questions or concerns, please email me: laborperm@gmail.com

Thanks for your input, labor perm. So, you would have to have a healthcare facility sponsor you, is that right? can you have a lawyer file a petition on your behalf w/o a sponsor for the mean time? what would happen if you dont find a sponsor and your OPT expires in July,08? Can I apply for that visa category next year? Any suggestions is highly appreciated.

. You are most welcome kaamchaiyo. You need to understand few basic things. First is this is an employment based petition. In order to file your petition, you need to have an employer who is willing to do that on your behalf. Some contract houses, who will find job for you can sponsor as well. You don't have to have hospital sponsor you, but if you go thru these consulting houses, they pay you less and you have to work for them for certain years. So my advise, find a hospital. If you don't find any healthcare facility who will sponsor you and if you run out of your OPT, next option is to go back to school. If you have ADN, go for BSN, and if you have BSN, go for MSN. Visas are distributed in limited basis. 500 visas are NOTHING. I would not count my entry on that. If you have any other questions, please refer to my email address: laborperm@gmail.com
