 going to nepal from mexico: SERIOUS SITUATION.

guys i have a friend in the us who is illegal, her visa had already expired like 2 years ago. And now she wants to go back to Nepal, but if she does so from the us then she will be prohibited to enter the states in the future so she wants to go to mexico as going there doesnt require a visa and fly from there to Nepal. So my question is:

1.Can she do that or does she need a mexican visa in order to fly back to Nepal?
2.Will she be stopped at the airport in mexico?
3.If she is successful in doing so can she come back to the states later in future?

please help guys its a really serious situation and she really needs some sensible advice.

Never heard before that Nepalese don't need visa to enter Mexico. So far as I know India is the only country that nepalese don't require visa.  Maybe New Nepal has added one more country on its list besides India.


Lets asssume for a moment that you don't need a visa for Mexico.


Re-entering USA has nothing to do with what route you enter Nepal. You won't be allowed to re-enter USA at any port of entry if you have lived here illegally unless you have a valid reason to not return your home country.

no you dont need to have a visa to go to mexico from us. yes if it was from Nepal then u wud need it, i know cause i went to mexico for a vacation few months back.


but if we go through the route i mentioned  how will the us government know tht she was residing illegally in the states, she might have went to Nepal before she was illegal?
i dont have much knowledge in this regard..

That is what i-94 is for. US keeps records of arrival and departure
date of each and every individual or assumes it should have record. If
she goes back to nepal and applies for visa later on, they they will
see that they have arrival record but no departure record of her; this
makes the thing messy, unless she has a very good reason for that, she
may get denial for visa.

Now u may say you don't need to give i94 if u travel by land, well u don't need if u r returning back within 30 days. If u r not returning back within 30 days then u shud give ur i94 at border.

 u may want to read following:
arrival departure laws.

It is your responsibility to ensure that your I-94/I-94W is turned in to Customs and Border Protection (CBP) at the end of your visit to the United States.

  • If you are departing by air, please turn the I-94/I-94W into the airline prior to departure.
  • If you are departing by sea, please turn the I-94/I-94W into the shipping line prior to departure.
  • If you are departing by land and you will not be returning to the United States within 30 days, please turn the I-94/I-94W into the Canadian or Mexican authorities upon departure from the United States.
Be sure to turn in the CBP Form I-94 or I-95 to the proper authorities on departure. This returned portion of the form proves you did not violate U.S. laws by overstaying your period of admission and staying in the country too long. It is evidence that you obeyed U.S. immigration laws and left timely, which is essential if you want to return to the United States at a future date as an immigrant or nonimmigrant.

Coming back to US for him or her is going to be big miracle. The roadway to US is a road without a bridge for that person period.

pilot23, The main thing is that whether she had those finger prints scanned in US Embassy in Nepal or not. If she had those scanned finger prints record then it's impossible. If she was the one who came US before those scanned finger prints period then it's not a big deal. Go back to Nepal and make a new passport. U can make it in Rs 20,000 and then apply for States as a freshman.

dudes, you can go Nepal via Mexico and  can come back via Mexico to U.S., but you need to show them your I-94, I-20 with proper signature even if you don't have valid visa. It says 30 days, since you don't have to handover your I-94, you can go beyound 30 days too.

This thread did makeme laugh. Let me add few more things....you can fly back to nepal via mexico but have her come back to mexico and take a 18 wheeler from cancun to any city in texas for another 1800 dollars then she will come back to USA without any problem. If you need contact ifo for the 18 wheeler please vist www.jose.com and you/her should have more information.
