I am currently on H1B. I haven't got my H1B stamped yet. I am working on a Client site and my contract is getting over by the end of October. I was planning to go Nepal between the jobs and get my H1B stamped. My employer is saying that I can travel and get H1B stamped even if I do not have a client. How true is that? Is it safe to travel without having job on hand? what docs do I need if it is possible?

Same situation here. I have my tickets in November and the client is releasing me end of October. My employer said it safe to travel as there will be contract paper (SOW and purchase order) between the Vendor and Client in H1B package. Having hard time to make a decision. Please update on your decision and what documents are you planning to carry with you during interview. What a shame that there are 148 views in 3 days but noone wants to provide suggestion.

If you employeer is decent (not small dhoti consultancies) you should have no problem getting your passport stamped since you are the full time employee of the company running your pay check. End client should not matter. But if your H1B is from small dhoti consultancy, there might be some hiccups gettting the passport stamped.

M also travelling but I have client letter and all. But dhoti has just filed for amendment with premium and I have ticket on 3rd week of November.
My doubt is what will happen if its not approved before I travel

Unfortunately it is dhoti consultancy with less than 100 employees. There was one case last year one of the Nepali went back without client job and got it stamped. I think you have to be really lucky. I will get my pay check until October but I dont have client letter as the client have a policy that they dont give client letter to consultant. Really having touch time to decide.

If it's dhoti consultancy then there is some kind of risk. It's totally up to you what amount of risk you are willing to take? There are cases when people in your situations got stamped and some who don't get stamped. Another think to consider is also whether your degree is matches the job you are doing. Good luck

Your notice of approval (I-797) for I-129 proves that you currently have a job. On the basis of I-797, you can apply for a visa. You will have to prove that you have the qualification that meets the requirement of Specialty Occupation (h1b) and have been currently working in US. If you could prove you’re working, you will easily get a new H1B visa.

Please bear in mind that embassy/consulate does not stamp passport. everytime you apply for a visa, you need to qualify for it.
