 Few questions regarding H1B from Non-Profit Org

I am a student on F1 status and I am about to complete my MS in Comp Science. I have a job offer from University, related to my field, and they are ready to file my H1 (non-profit) with premium processing.

Let say I accepted this job now (Jan) and want to quit it around June to join a different For-Profit organization.

I think my NON-Profit H1 will not be transferrable to the new For-Profit organization, so my new employer will have to file new H1 in April next year

Now my questions are:

1.       Will I be able to accept this new position (For-Profit) right away?

2.       If yes, then what status will I have from June (time when I quit Univ job) to Next April-Oct (New H1 filing time)?

3.       What will happen if I get fired from the University job? How am I going to save my status? Will I be able to use my OPT period? Will I be able to stay in US with my NON-Profit H1 visa, although I don’t have any job (because I was fired)?

 

It would not be so many problems if the university had sponsored Green Card for me but that won’t happen. They will only do my H1 to keep me in the job.

To me it seems accepting this University job is like inviting unnecessary hassles in future.

What would you guys suggest me? Take this job or wait and find another For-Profit job?

i am not 100% sure but i am fairly positive that it will fall under STEM.

Since the university is not going to sponsor your green card and you will be working for them temporarily, i think you can work for them on ur OPT...and then look for for-profit companies who will apply for your h1b...as soon as you find one and on the right time to apply for your h1, move on...i guess that will be best...

I don't give suggestions for free. But for this time i spent my time free for you. Do one thing, just go for university job. Don't think about future that way,who knows what happen in the future. Remember AdamSmith's Golden Rule "In the long run We all die".

Having h1 with non profit organizations mean you are already approved for h1b visa. They can file your h1 at any time and you will instantly approved.  What you need more than that. but if you file through the normal quota(profit -h1) you have to go through the lottery system. There are so many people who have job but no h1 and vice versa. Plus you will make a really good money. I wish either me or so many friends in sajha in such  condition. We even don't have a single choice, and you have opportunities knocking on your door right way.

Regarding your 2 questions no.  1 and no. 2  i don't have any answer as i already told you not to think about it.

3.

If you get fired you can't use your h1 visa as no job means no h1. I don't think you can use your OPT either cause it would collapse when you're approved from h1. don't know exactly though. Do some googling too.

And why are you being afraid of getting fired? if your university is offering you a job, that means they saw something in you. Stop being worry about getting fired.

Bottom Line. : Go for your University job. if you don't, u will be the most idiot person of this world.

Solution to all your problems:

Once u file for H1 through non-profit organisation and get approved , you are done. U can then transfer your H1 to either profit or non-profit organisation.

Filing H1 for quota may not get approved but transfer of H1 will surely get approved.
